Commercial Real Estate

Is there a legal limit on rent increases for commercial premises?

Answer

Yes. Under Article 344 of the Turkish Code of Obligations, the increase for a renewed lease year on roofed commercial premises may not exceed the 12-month average consumer price index (CPI) of the previous lease year.

At the end of a five-year lease period and every five years thereafter, if the parties cannot agree, the rent is set by a judge based on comparable rents and fairness. The 25% cap that applied to residential rents for a period did not cover commercial premises and ended in July 2024.
